Description

Nintendo and Amazon have achieved a significant legal victory in their ongoing battle against counterfeit amiibo distribution.

According to a recent report from Polygon, the two companies jointly secured a favorable judgment in their lawsuit against two resellers accused of distributing fake amiibo figures through the Amazon e-commerce platform.

This case, initially filed in October 2023 with the Seattle district court, underscores the high stakes involved in safeguarding intellectual property within the gaming industry. The amiibo product line, consisting of NFC-enabled figurines and cards compatible with popular Nintendo Switch titles, has grown into a major collectible phenomenon since its introduction.

With this surge in popularity, counterfeit amiibo began to appear on third-party marketplaces, prompting Nintendo to take firm legal action alongside Amazon. In February 2025, both Nintendo and Amazon requested the court to issue a default judgment after the defendants failed to respond to the lawsuit.

Seattle district judge Marsha J.

Pechman granted their motion, awarding Nintendo over $7 million in damages and ordering the resellers to cease all sales of counterfeit products via Amazon.

The sellers' accounts, initially suspended by Amazon in 2023, will remain closed following this decisive court order. This legal victory highlights Nintendo's commitment to combating counterfeit goods throughout its supply chain.

In the original complaint, Nintendo executives outlined the company's comprehensive approach to brand protection: "Nintendo employs a combination of in-house expertise and external partners to combat counterfeits.

Working with a third-party brand protection service, Nintendo continually monitors and removes product listings that infringe on its IP rights.

Collaborating regularly with Amazon, both companies have strengthened their automated systems to identify and remove counterfeit Nintendo products from the Amazon marketplace." The verdict not only delivers a major blow to those engaged in the sale of fake amiibo but also sends a clear signal to other would-be counterfeiters about the serious legal and financial consequences of infringing on Nintendo’s intellectual property.

Furthermore, the partnership between Nintendo and Amazon demonstrates an industry-leading approach to digital brand enforcement—one that safeguarding legitimate customers and their eShop purchases on the Nintendo Switch. As Nintendo continues to expand its presence globally through software, hardware, and collectibles like amiibo, this legal outcome sets a strong precedent for ongoing brand protection across all platforms.

For gaming fans, developers, and industry stakeholders alike, the ruling reaffirms the importance of authentic products and robust IP rights enforcement in today's digital marketplace.
