James Pond Legacy: The Pond is Not Enough has become the focal point of a debate over generative AI in game art after a trailer and key art drew viewer accusations this summer.

The four-game retro collection, developed by Antstream and published by System 3, is scheduled to launch exclusively on Nintendo Switch 2 in October 2026.

Controversy centered on whether algorithmic tools were used to produce non-in-game illustrations and promotional material.

System 3 CEO Mark Cale told GameSpot that a breakdown in communication between publisher and developer led to the confusion.

Cale said System 3 was not directly involved in the art production process and that Antstream supplied both final artwork and a work-in-progress illustration.

He explained the publisher relied on a written statement from Antstream describing the art pipeline when preparing disclosures for digital storefronts and platform holders.

According to the statement provided by Antstream, original 2D concept art was processed through an algorithm-assisted pipeline that estimated volume and lighting to produce pseudo-3D drafts.

Artists then manually repainted and finalized all illustrations, and the company characterized the final assets as fully human-authored with algorithmic tools used only for intermediary visualization.

Cale said System 3 interpreted the wording as indicating no generative AI had been used in final assets.

Cale paraphrased his position that the Antstream wording did not explicitly use the term "generative AI," and that System 3 relied on that wording when preparing materials for Nintendo, Steam, PS5 and Xbox.

He added the publisher had requested the statement to cover platform requirements and to meet transparency provisions under the EU Artificial Intelligence Act, which took effect on August 2, 2026.

James Pond creator Chris Sorrell, who was not involved with the collection, publicly criticized the project; one notable remark from Sorrell expressed strong disapproval toward the team responsible for the release.

Fans initially remained skeptical even after System 3 denied heavy generative AI use.

Cale told reporters Antstream was selected because of its prior work on System 3 retro compilations such as The Last Ninja Collection.

He also defended the practical limits of producing entirely new, hand-drawn box-art-quality illustrations, saying the time and staffing required would be prohibitive relative to the investment return.

To avoid future misunderstandings, Cale said System 3 plans to establish clearer internal guidelines on what the company considers generative AI and how that should be disclosed to platform holders and the public.

The game remains on track for its Nintendo Switch 2 exclusive release window in October 2026, with a specific date yet to be announced.
