Description

Nintendo and accessory manufacturer Genki have officially settled a recent legal dispute concerning unauthorized promotion of accessories for the highly anticipated Nintendo Switch 2.

The legal action began in May 2024 when Nintendo filed a lawsuit after Genki showcased prototype accessories for the upcoming Nintendo Switch successor, purportedly based on access to confidential information prior to any official console announcement. The heart of Nintendo's suit revolved around Genki's public display of 3D mockups, which they claimed represented the Nintendo Switch 2 as early as January 2025.

These prototypes were highlighted in Genki’s marketing materials, giving the broader gaming community an unofficial first glimpse of the next-generation hardware ahead of Nintendo’s planned reveal.

Nintendo contended that Genki obtained details about the new hardware through unauthorized channels, violating strict confidentiality standards the company maintains for unreleased products. Newly released court documents, first reported by Nintendo Soup, confirm that both Nintendo and Genki have resolved their dispute through an out-of-court settlement.

As part of the agreement, Genki is required to pay an undisclosed monetary sum to Nintendo.

Furthermore, Genki has agreed to cease using Nintendo’s proprietary color schemes and brand identifiers, including discontinuing names like 'Glitch 2' for hardware products and refraining from branding presentations as 'Genki Direct,' which previously echoed Nintendo’s well-known Direct showcases. In a restatement of the official communications, court filings make clear that Genki is to halt all promotional activities referencing unreleased Nintendo Switch 2 products or leveraging Nintendo-specific branding.

The move comes as Nintendo continues its consistent and aggressive approach toward IP protection, following a string of actions targeting leaks and unauthorized use of its trademarks. Nintendo Switch 2 remains unannounced at the time of writing, with official details expected through future Nintendo Direct presentations.

Genki, known for its innovative third-party solutions for current Nintendo hardware like the Nintendo Switch and digital products on the eShop, has developed a reputation for aligning new products with Nintendo's ecosystem.

However, the recent litigation underscores the importance Nintendo places on safeguarding its product reveals and brand identity from premature or unofficial exposure. This settlement adds to Nintendo’s long-standing history of legal vigilance in the gaming industry, ensuring the integrity of its hardware launches and the value of its intellectual property for consumers and partners alike.

As anticipation builds for the Nintendo Switch 2, industry stakeholders can expect Nintendo to maintain its firm stance on IP security throughout the transition to next-generation hardware.
